Two people have been convicted for the killing of a suspected thief who was lynched on May 15 last year at Onyinore village in Gem sub-County.
Bernard Otieno and Alex Onono were convicted of murder after they were found guilty of killing Daniel Rambo whom they had accused of stealing a mobile phone.
According to a judgment delivered by Justice Roselyne Aburili at Siaya Law Courts, the suspects were blamed for their involvement in the gruesome murder by a mob.
“All those who took part in the unlawful transaction did not deem it fit to apprehend the suspect and hand him over to law enforcers. Instead, they decided to take the law into their own hands,” Aburili said.
According to her judgment, those who took part in the act must be held criminally responsible for the consequences of their unlawful actions.
“They were not permitted under any circumstances to do so and having done so, they came into direct conflict with the law,” she said.
The court established that the suspect died as a result of the serious injuries sustained following the assault.
According to a post-mortem report dated May 30, the 39-year-old victim had bruises on the back of the skull, right shoulder, right forearm, left side of the forehead and cheek, right side of the chest and on both feet .
Dr. Rita Aoko Opondo, a medical officer at Bondo sub-County Hospital testified that the suspect died due to blunt force trauma on the head.
Daniel Otieno’s mother and sister whose phone had allegedly been stolen testified that the suspect was brought to their home by people known to them before he was lynched.
Otieno’s sister said the people who brought the suspect called her brother and that she saw Onono hit the suspect on the head with a piece of wood. Otieno also assaulted him, she testified.
Otieno said that he never assaulted Rambo and only helped in administering first aid.
